Terms of Service

IndieSearch.ai is a B2B SaaS validation copilot that helps indie hackers and micro-SaaS founders validate business ideas through AI-powered market research, A/B landing page testing, AI surveys, analytics, and decision frameworks. Our Service provides informational tools and insights—not business, legal, financial, or investment advice.

Pricing Model: Your first idea validation is free. Subsequent validations cost $9 per idea. All payments are processed through our Merchant of Record, Lemon Squeezy.

2.1 Business Use. This Service is intended for business, commercial, or professional purposes. By using IndieSearch.ai, you represent that you are accessing the Service for business purposes and not as a consumer. If you are a consumer in the European Economic Area, nothing in these Terms limits any mandatory consumer protections under your local law.

2.2 Age and Authority. You must be at least 18 years old. If accessing on behalf of an organization, you represent you have authority to bind that organization to these Terms.

2.3 Account Security. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

3.1 Merchant of Record. Payments are processed by Lemon Squeezy, our Merchant of Record. When you complete a purchase, you enter into a transaction with Lemon Squeezy for payment processing purposes while IndieSearch.ai remains responsible for Service delivery. By purchasing, you also agree to Lemon Squeezy's Buyer Terms at https://www.lemonsqueezy.com/buyer-terms.

3.2 Pricing. The first idea validation is free. Subsequent validations are $9 per idea (or as displayed at checkout), inclusive of applicable taxes handled by Lemon Squeezy.

3.3 Refund Policy. Due to the immediate digital delivery nature of validation reports, we generally do not offer refunds once a report has been generated. However, we may offer refunds or credits at our discretion for documented technical failures preventing report delivery or significant service malfunctions. 3.4 Consumer Withdrawal. If you are a consumer in the EU/EEA purchasing validation services, by completing checkout you expressly consent to immediate performance and acknowledge you lose your statutory 14-day withdrawal right once your validation report is generated.

You agree not to:

•Use the Service for illegal, fraudulent, or harmful purposes •Create landing pages containing phishing content, malware, counterfeit product promotions, adult content, hate speech, or discriminatory material •Upload content that infringes third-party intellectual property rights •Attempt to reverse engineer, decompile, or extract source code from our platform •Use automated systems to scrape or extract data without authorization •Circumvent technical limitations or security measures •Use the Service to develop competing products or conduct competitive analysis •Submit false or misleading information in validation requests •Violate any applicable law, including data protection regulations

We reserve the right to remove content and suspend or terminate accounts for violations.

5.1 AI Disclosure. IndieSearch.ai uses artificial intelligence, including models from third-party providers such as Anthropic (Claude), to generate market research, surveys, decision frameworks, and validation insights.

5.2 Accuracy Limitations. By using AI features, you acknowledge:

•AI-generated outputs are probabilistic predictions that may be inaccurate, incomplete, outdated, or contain errors •You should not rely on AI outputs as your sole basis for business decisions •We recommend applying human judgment and independent verification before acting on any AI-generated recommendations •AI outputs do not constitute professional business, legal, financial, or investment advice •We make no warranties regarding the accuracy, reliability, or completeness of AI outputs

5.3 Third-Party AI Providers. Our AI features utilize third-party services. We disclaim all liability for third-party AI performance, accuracy, or data handling. Third-party providers may process data under their own terms and retention policies.

5.4 Your Responsibility. You are solely responsible for all business decisions made based on AI outputs. Your use of AI features is at your own risk.

6.1 Your Content. You retain ownership of content you submit, including business ideas, descriptions, landing page copy, images, and designs. By submitting content, you grant IndieSearch.ai a non-exclusive, worldwide, royalty-free license to host, store, display, and process your content through our AI systems solely to provide the Service. This license terminates when you delete your content or close your account, except for aggregated, anonymized data.

6.2 AI-Generated Outputs. Validation reports and AI-generated insights created from your inputs are assigned to you. However, AI-generated content may not qualify for copyright protection under applicable law. IndieSearch.ai retains ownership of underlying AI models, algorithms, methodologies, platform technology, and general insights derived from aggregated anonymized data.

6.3 Feedback. If you provide suggestions, ideas, or feedback about the Service, you grant us an unlimited, irrevocable, royalty-free license to use and incorporate such feedback without compensation.

6.4 Our Platform. IndieSearch.ai, including its software, design, trademarks, and documentation, is owned by Digitala Idéfabriken Malmö AB and protected by intellectual property laws.

7.1 Controller Responsibilities. When you create landing pages that collect visitor data (emails, names, IP addresses), you are the data controller under GDPR for that visitor data. You determine what data to collect, how to use it, and for what purposes. IndieSearch.ai acts as your data processor for visitor data.

7.2 Your Obligations. You agree to:

•Comply with GDPR and all applicable data protection laws •Provide a compliant privacy policy on your landing pages •Obtain valid consent for data collection where required •Implement appropriate cookie consent mechanisms •Honor data subject rights requests from your visitors •Only collect data for lawful purposes

7.3 Data Processing Agreement. Our Data Processing Agreement (DPA) governs our processing of visitor data on your behalf and is incorporated by reference.

8.1 Service "As Is". THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

8.2 No Success Guarantees. VALIDATION SCORES, MARKET INSIGHTS, AND AI RECOMMENDATIONS ARE EDUCATIONAL INDICATORS OF POTENTIAL, NOT GUARANTEES OF SUCCESS OR FAILURE. MARKET CONDITIONS ARE INHERENTLY UNPREDICTABLE. ANY ACTION BASED ON OUR OUTPUTS IS ENTIRELY YOUR RESPONSIBILITY.

8.3 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

(a) Our total aggregate liability for claims arising from these Terms or the Service shall not exceed the greater of (i) total fees paid by you in the twelve months preceding the claim, or (ii) one hundred US dollars ($100).

(b) We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, business opportunities, or goodwill, regardless of cause and even if advised of the possibility.

(c) These limitations apply to all claims whether based on contract, tort, strict liability, or any other theory.

8.4 Jurisdictional Exceptions. Some jurisdictions do not permit limitation of certain damages. If you are in such a jurisdiction, some limitations may not apply to you to the extent prohibited by applicable law.

You agree to indemnify, defend, and hold harmless IndieSearch.ai, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

(a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or third-party rights; (d) content you submit; or (e) your landing pages and your visitors' claims.

10.1 By You. You may close your account at any time by contacting hello@indiesearch.ai. Upon closure, your access terminates immediately with no refunds for unused purchases.

10.2 By Us. We may suspend your account for suspected Terms violations or security concerns, providing notice and opportunity to remedy where appropriate. We may terminate accounts immediately for material breaches, illegal activity, or repeated violations.

10.3 Effect of Termination. Upon termination, you lose all rights to the Service. We will retain your data for 30 days to allow data export, then delete personal data per our Privacy Policy (except records retained for legal obligations).

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 30 days before the changes take effect. Continued use after changes become effective constitutes acceptance. If you disagree, you must stop using the Service.

12.1 Governing Law. These Terms are governed by the laws of Sweden, without regard to conflict of law principles.

12.2 Jurisdiction. Any disputes arising from these Terms shall be resolved exclusively by the courts of Malmö, Sweden.

12.3 EU Consumer Rights. If you are a consumer in the European Union, nothing in these Terms deprives you of mandatory consumer protections in your country of residence. You may bring proceedings in your local courts.

13.1 Entire Agreement. These Terms, together with our Privacy Policy and DPA, constitute the entire agreement between you and IndieSearch.ai.

13.2 Severability. If any provision is found unenforceable, the remaining provisions continue in effect.

13.3 No Waiver. Failure to enforce any right does not waive that right.

13.4 Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or successor.
